By requesting, approving, scheduling, or receiving services from Chapman Curb Appeal, LLC (“Company,” “we,” “us,” or “our”), the customer agrees to the following Terms & Conditions.

Estimates & Quotes

All estimates and quotes are based on the information and conditions available at the time the estimate is prepared. Pricing may change if the scope of work changes, additional work is requested, or unforeseen conditions are discovered after work begins.

Any additional work outside the original approved scope may result in additional charges. We will make reasonable efforts to communicate significant changes before proceeding.

Quotes are valid for the period stated on the estimate. Material prices and availability may change after the quote expires.

Deposits & Materials

Certain landscaping projects may require a deposit before materials are ordered or work is scheduled.

Deposits may be used toward materials, equipment, labor, delivery fees, disposal fees, and other costs associated with preparing for the project.

Once custom, special-order, or project-specific materials have been purchased, those material costs may be non-refundable to the extent permitted by applicable law.

Payment

Payment is due according to the terms shown on the customer's invoice or approved quote.

Customers are responsible for ensuring payment is made by the due date.

For recurring services, customers may be billed after each service or on an agreed billing schedule.

Any applicable sales tax will be added when required by Texas law.

Financing

Chapman Curb Appeal, LLC may provide customers with access to financing or payment-plan options through independent third-party financing providers.

Financing approval, interest rates, payment amounts, repayment terms, fees, credit requirements, and other financing conditions are determined solely by the financing provider.

Chapman Curb Appeal, LLC does not guarantee financing approval and is not the lender unless expressly stated otherwise.

Customers should review and agree to the financing provider's separate terms before accepting financing.

Cancellations & Rescheduling

Please provide as much notice as possible when cancelling or rescheduling scheduled work.

Projects involving purchased materials, equipment rentals, special orders, or other expenses incurred specifically for the customer's project may be subject to charges if cancelled after those expenses have been incurred.

Chapman Curb Appeal, LLC reserves the right to reschedule work because of weather, unsafe working conditions, equipment problems, material delays, emergencies, or circumstances outside our reasonable control.

Weather Delays

Landscaping and lawn-care services are weather dependent.

Rain, excessive heat, saturated soil, drought conditions, storms, freezes, and other environmental conditions may delay scheduled services or projects.

Weather-related scheduling changes do not constitute abandonment or cancellation of an agreed project.

Property Access

Customers are responsible for providing reasonable access to areas where services will be performed.

Gates should be unlocked and pets should be secured before our arrival.

If we cannot safely access the property, the service may need to be rescheduled and additional trip or service charges may apply when disclosed and permitted.

Underground & Hidden Items

Customers should notify Chapman Curb Appeal, LLC of known underground or concealed items, including irrigation lines, sprinkler heads, drainage systems, landscape lighting wires, invisible fencing, private utility lines, and other property features that may not be readily visible.

Chapman Curb Appeal, LLC is not responsible for damage to undisclosed, improperly installed, unmarked, or concealed private systems to the extent permitted by applicable law.

Nothing in these Terms limits responsibility that cannot legally be limited under applicable law.

Irrigation Systems

Customers are responsible for notifying us of known irrigation problems before landscaping work begins.

Existing sprinkler heads, pipes, wiring, valves, or irrigation components may sometimes be located close to the surface or hidden beneath vegetation, soil, mulch, or other materials.

If an existing irrigation problem is discovered during a project, additional repairs may require a separate estimate.

Lawn & Landscape Results

Plants, sod, seed, fertilizer, weed-control applications, and other living landscaping materials are affected by weather, irrigation, soil conditions, insects, disease, pets, wildlife, and customer maintenance.

Unless a written warranty is specifically included with the customer's project, Chapman Curb Appeal, LLC cannot guarantee the continued survival, growth, color, or condition of living plants, grass, or other landscape materials after installation.

Customers are responsible for following watering and aftercare instructions provided for their project.

Existing Property Conditions

We are not responsible for pre-existing damage or conditions that existed before our work began.

When appropriate, photographs or videos may be taken before, during, and after work to document property conditions and completed services.

Customer-Requested Changes

Changes requested after a project has begun may affect the final price and completion schedule.

Additional labor, materials, disposal, delivery, or equipment required because of customer-requested changes may be billed separately after customer authorization as required.

Completion & Final Inspection

Customers should inspect completed project work within a reasonable period and notify Chapman Curb Appeal, LLC promptly of any concerns.

We appreciate the opportunity to inspect and address legitimate concerns regarding our workmanship before outside repairs or modifications are performed.

Photos & Marketing

Chapman Curb Appeal, LLC may photograph completed landscaping or lawn-care work for documentation and portfolio purposes.

We will not intentionally publish personally identifying information, house numbers, license plates, or other sensitive information as part of marketing photographs.

Customers who do not want photographs of their completed project used for marketing may notify us.

Safety

For everyone's safety, customers, children, pets, and other individuals should remain away from active work areas and operating equipment.

Chapman Curb Appeal, LLC may stop or postpone work if conditions are unsafe.

Right to Refuse or Discontinue Service

Chapman Curb Appeal, LLC reserves the right to decline or discontinue service when permitted by law, including because of unsafe conditions, abusive or threatening behavior, repeated nonpayment, inability to access the work area, or material violations of an agreed service arrangement.

Customers remain responsible for authorized work already completed and non-refundable project expenses already incurred, subject to applicable law.

Limitation of Terms

Nothing in these Terms & Conditions is intended to waive or restrict rights or remedies that cannot legally be waived under Texas or federal law.

If any provision of these Terms is determined to be unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

Updates to These Terms

Chapman Curb Appeal, LLC may update these Terms & Conditions periodically. The version applicable to a particular service or transaction will be the version presented or incorporated into the applicable agreement at that time.
